Spexi Geospatial Inc. (“Spexi”, “we”, “us”, “our”) treats compliance with its privacy obligations seriously. This Privacy Policy (“Policy”) outlines how we collect, use, share, and protect the information of our users ("you"). This Policy also describes types of information we may collect from you or that you may provide when you use our sites, mobile apps, and other online products and services (collectively, the "Services") or when you otherwise interact with us or receive a communication from us as well as your rights regarding your information.
Please read this Policy carefully to understand our policies and practices for collecting, processing, and storing your information. If you do not agree with our policies and practices, please do not use our Services. By accessing or using the Services, you indicate that you understand, accept, and consent to the practices described in this Policy.
Exclusions
We collect and use several types of information from and about you, including:
Personal information, that we can reasonably use to identify you directly or indirectly, such as your name, mailing address, email address, telephone number, Internet protocol (IP) address used to connect your computer to the Internet, username or other similar identifier, billing and account information (including information relating to cryptocurrency holdings and crypto wallet information) and any other identifier we may use to contact you ("personal information").
Non-personal information, that does not directly or indirectly reveal your identity or directly relate to an identifiable individual, such as demographic information, or statistical or aggregated information. For example, we may aggregate personal information to calculate the percentage of users accessing a specific feature of the Services.
Usage Data, including your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform, or information about your internet connection, the equipment you use to access our sites, and usage details.
Technical Data, including the full Uniform Resource Locators (URLs), clickstream to, through and from our sites(including date and time), products you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, or any phone number used to call our customer service number.
Stored information and files. Our mobile applications may also access metadata and other information associated with other files stored on your device that are transmitted through the mobile applications. For example, photographs captured by drone technology via the Spexi Network.
Location information. Our mobile applications collect real-time information about the location of your device. If you do not consent to the collection of this location data, you cannot use the service as it is location dependent
We use different methods to collect your information, including through:
Direct interactions with you when you provide it to us, for example, by filling in forms or corresponding with us by phone, email, or otherwise.
User contributions. You may also provide information for us to publish or display on public sites areas or transmit to other users or third parties.
Automated technologies or interactions, as you navigate through our sites. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.
Information You Provide to Us
The information we collect directly from you on or through our Services may include:
Information that you provide by filling in forms on the Services. This includes information and material provided, posted, or uploaded at the time of registering to use the Services, subscribing to our service offerings, or requesting further services. We may also ask you for information when you report a problem with our Services
Records and copies of your correspondence (including email addresses), if you contact us.
Your responses to surveys that we might ask you to complete for research purposes.
Details of transactions you carry out through the Services and of the fulfillment of your orders. You may be required to provide financial information before transacting on the Services.
Your search queries on our sites.
Automatic Information Collection and Tracking Technologies
As you navigate through and interact with our sites, we may use cookies or other automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:
Details of your visits to our sites, including traffic data, location data, logs, and other communication data and the resources that you access and use on our sites.

The information we collect automatically is statistical information and may include personal information, and we may maintain it or associate it with personal information we collect in other ways, that you provide to us, or receive from third parties. It helps us to improve our Services and to deliver a better and more personalized service, including by enabling us to:

Store information about your preferences, allowing us to customize the Services according to your individual interests.
Speed up your searches.
Recognize you when you return to our sites.
The technologies we use for this automatic data collection may include:
Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our sites. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our sites. We also provide the opportunity to opt-out of cookies being placed on your computer.
Flash Cookies. Certain features of our sites may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on our sites. Flash cookies are not managed by the same browser settings that are used for browser cookies.
Web Beacons. Pages of our sites and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Spexi, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
We do not collect personal information automatically, but we may tie non-personal information collected automatically to personal information about you that we collect from other sources or that you provide.
We use information that we collect about you or that you provide to us, including any personal information:
To present our Services and their content to you.
To provide you with information, products, or services that you request from us.
To fulfill the purposes for which you provided the information or that were described when it was collected, or any other purpose for which you provide it.
To provide you with notices about your account.
To carry out our obligations and enforce our rights arising from any contracts with you, including for billing and collection or to comply with legal requirements.
To notify you about changes to the Services or any products or services we offer or provide though it.
To improve the Services or customer relationships and experiences.
We may use information for direct marketing and online behavioral advertising purposes after you opt-in for such use (and not after you opt-out).
In any other way we may describe when you provide the information.
For any other purpose with your consent.
We may also use your information to contact you about our own and third-parties' goods and services that may be of interest to you, as permitted by law. If you do not want us to use your information in this way, please check the relevant box located on the form on which we collect your data or use the unsubscribe mechanism at the bottom of our e-mails.
We may disclose information about you after it has been aggregated such that it does not identify you or any individual. As noted above, such aggregated information is not “personal information.”
We may disclose personal information that we collect or you provide as described in this privacy policy:
In accordance with applicable law, to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Spexi's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Spexi about our customers and users is among the assets transferred.
To contractors, service providers, and other third parties we use to support our business and who are contractually obligated to keep personal information confidential, use it only for the purposes for which we disclose it to them, and to process the personal information with the same standards set out in this Policy.
To your employers, where you are using the Services in your capacity as an employee. As a service provider to employers, we collect, analyze and disclose usage data relating to our mobile applications on behalf of some employers. In this role, Spexi is a data processor, processing data upon instruction from employers.
To fulfill the purpose for which you provide it.
For any other purpose disclosed by us when you provide the information.
With your consent.
We may also disclose your personal information:
to comply with any court order, law, or legal process, including to respond to any government or regulatory request, in accordance with applicable law.
to enforce any of our rights or apply any terms of use associated with the Services and other agreements, including for billing and collection purposes.
if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Spexi, our customers, or others.
We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information.
Tracking Technologies and Advertising. You may be able to set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.
Access or update your information. If you have registered for an account with us through the Service, you may review and update certain account information by logging into the account.
Opt-out of marketing communications. You may opt-out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by contacting us. Please note that if you choose to opt-out of marketing-related emails, you may continue to receive service-related and other non-marketing emails.
Promotional Offers from Spexi. If you do not wish to have your contact information used by Spexi to promote our own or third parties’ products or services, you can opt-out by checking the relevant box located on the form on which we collect your data, or at any other time by logging into the Services and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes, or by sending us an email stating your request to privacy@spexi.com. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to Spexi as a result of a product purchase, warranty registration, product service experience or other transactions.
Do Not Track. Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. We currently do not respond to “Do Not Track” signals. To find out more about “Do Not Track,” please visit http://www.allaboutdnt.com.
Spexi does not sell your personal data as that term is defined by various state and other laws. For this reason we do not provide an “opt out” of sale functionality.
We do not control third parties’ collection or use of your information. However, you can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.
We are headquartered in Canada and may use service providers that operate in the US or in other countries outside the country in which you reside. Therefore, your personal information may be transferred to countries which may not provide for the same level of data protection as guaranteed under the applicable data protection laws of the country in which you reside. For all such transfers we ensure that these countries are either considered adequate according to the applicable data protection law (e.g., by way of an adequacy decision of the EU commission) or that appropriate safeguards are in place such as standard contractual clauses. We may transfer personal information that we collector that you provide as described in this Policy to contractors, service providers, and other third parties we use to support our business and who are contractually obligated to keep personal information confidential, use it only for the purposes for which we disclose it to them, and to process the personal information with the same standards set out in this Policy.
By submitting your personal information or accessingthe Services, you consent to this transfer, storage, or processing.
The security of your personal information is very important to us. We maintain appropriate physical, organizational, and technological safeguards against unauthorized access, unauthorized disclosure, theft, or misuse appropriate to the sensitivity of such Personal Information.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to the Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to on or through the Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Services.
Except as otherwise permitted or required by applicable law or regulation, we will only retain your personal information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.
The Services are not intended for children under 16years of age. No one under age 16 may provide any information to us directly or through the Services, and we do not knowingly collect personal information from children under 16. If you are under 16, you may not use the Services. If we learn we have collected or received personal information from a child under 16without verification of parental consent, we will delete that information. It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes. You have the right to request access to and to correct the personal information that we hold about you (see below for more information).
You can review and change certain of your personal information by logging into your account associated with the Services and visiting your account profile page.
We may request specific information from you to help us confirm your identity and your right to access, and to provide you with the personal information that we hold about you or make your requested changes. Applicable law may allow or require us to refuse to provide you with access to some or all of the personal information that we hold about you, or we may have destroyed, erased, or made your personal information anonymous in accordance with our record retention obligations and practices. If we cannot provide you with access to your personal information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.
We will provide access to your personal information, subject to exceptions set out in applicable privacy legislation. Examples of such exceptions include:
information protected by solicitor- or attorney-client privilege.
information that is part of a formal dispute resolution process.

To with draw your consent, if applicable, contact us at privacy@spexi.com. Please note that if you withdraw your consent we may not be able to provide you with a particular product or service. We will explain the impact to you at the time to help you with your decision.
State consumer privacy laws mayprovide their residents with additional rights regarding our use of theirpersonal information. Regardless of yourstate of residence, you have the following rights:
Right to know – you can request confirmation about whether or not we have collected your personal information and information about the categories of information we have collected. Spexi does not collect any sensitive personal information for any purpose.
Right to access – you may request a copy of certain personal information we have collected about you.
Right to delete – you can ask us to delete certain personal information we maintain about you.
Right to correct – you may ask that we correct inaccurate personal information about you. To exercise any of these rights please contact privacy@spexi.com. We reserve the right to confirm your identity before taking any of the requested actions.
We reserve the right to modify this Policy at any time. If we make material changes to this Policy, we will notify you by updating the date of this Policy and posting it on the Service. If required bylaw we will also provide notification of changes in another way that we believe is reasonably likely to reach you, such as via email or another manner through the Service. Any modifications to this Policy will be effective upon our posting the modified version (or as otherwise indicated at the time of posting).Your continued access to or use of the Services after any such amendment constitutes your acceptance of the Policy as then amended.
We have procedures in place to receive and respond to complaints or inquiries about our handling of personal information, our compliance with this Policy, and with applicable privacy laws.
